  • Unfair dismissals.
  • Unfair discrimination.
  • Enforcement of restraint of trade obligations.
  • Guiding and assisting with internal dispute resolution, such as disciplinary hearings, grievances and allegations of unfair conduct and discrimination, harassment, and victimisation.
  • Drafting contracts/policies. 
  • Providing internal training and employment-related presentations.
  • Compliance audit disputes regarding employment legislation and employment-related litigation in the Commission for Conciliation, Mediation and Arbitration (CCMA), bargaining councils, private arbitrations, Labour Court and High Court.

COLLECTIVE BARGAINING AND STRIKES

  • Advising on preparation for collective bargaining and dealing with both protected and unprotected strikes, including obtaining court orders to interdict and protect industrial action and unlawful conduct during strike action.
  • Advising on and/or drafting collective agreements across all bargaining units.
  • Advising on exemption/variation applications made to the DOL and organisational rights disputes.

TRANSACTIONAL EMPLOYMENT LAW

Advising employers on employment law consequences arising from commercial matters such as restructuring (small and large scale), reorganisation, as well as the employment law consequences of a sale of business and outsourcing agreements. Advising on independent contract relationships and arms-length service agreements.
